The Japanese Financial Service Agency has in its review proposed the treatment of cryptocurrencies as financial assets. Capital gains on financial securities are taxed at 20%. The blockchain law and regulation of Japan classifies cryptocurrencies as constituent of miscellaneous income.
The current rate on profit for miscellaneous income progresses from 5% – 45%, while an additional 10% tax is payable to the local government as inhabitant tax. Making it 15% – 55% in taxation on miscellaneous commodities. Forming a major regulatory compliance structure to curb risks of loses from decentralization risks.

Why the Strict Regulations on Crypto Assets?

Strict regulations on crypto assets followed in the collapse of Japanese company Mt. Gox, a cryptocurrency exchange platform in 2014. Its collapse in 2014 was as a result of a hack on the platform which eventually led to loss of bitcoin investors’ funds on the platform.

Mt. Gox was declared bankrupt afterwards in 2014. Leading in a clampdown on cryptocurrency by the Japanese Government. With the government issuing high tax values on crypto profits.

Why the Tax Reform Consideration?

There has been an increased number of participants in the crypto space within the Japanese populace. With reports suggesting about 350,000 to 500,000 active Japanese traders within the crypto space in 2014.

There has also been reports of the Japanese giant company Sony acquiring the crypto platform Amber Japan.

Sony Group is a Japanese multinational conglomerate corporation and a leading figure in global technological advancement. With a huge presence in gaming, music, camera, phones and electronics among others.

With big players and increasing population adopting cryptocurrency, as well as the ongoing repayment being made by Mt. Gox, to customers affected in the 2014 hack, there is a combination of factors available to influences confidence in the crypto space.

When will the Reform Proposal be Implemented?

It is important to note that request filing or proposal does not translate to immediate change in rule. Ministries and Agencies on a yearly basis submit requests for regulatory changes to be deliberated on and reviewed by the parliament and various governing bodies. Which could lead to changes in legal regulations.
